There are two types of Appeal under RTI: First Appeal under Section 19(1) and 19(2) before First Appellate Authority, and Second Appeal under Section 19(3) before Central Information Commission or State Information Commission.
When can I file for First Appeal?
A First Appeal can be filed under Section 19(1) of the Right to Information Act under two conditions.
The concerned Public Information Officer(PIO) who dealt with your RTI Application has sent an unsatisfactory answer to your RTI Application and you are dissatisfied with the answer.
The concerned PIO who dealt with your RTI Application has not sent any reply/answer to you. PIO should be sending you the RTI reply within a time period of 30 days. These 30 days are counted from the date your RTI Application was received by the PIO. It is mandatory for the PIO to reply to your RTI application within this time period.
